1. Agreement to Terms

By accessing or using the SiteWebster platform and website (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Service. These terms apply to all users, including visitors, customers, and anyone who accesses or uses the Service.

2. Description of Service

SiteWebster provides an all-in-one business platform that includes website building, customer relationship management (CRM), AI tools, appointment booking, email and SMS marketing, automations, and related features. The platform is powered by GoHighLevel and white-labelled for Canadian businesses. SiteWebster is available to businesses in Canada and the United States.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activity that occurs under your account

You must be at least 18 years old and legally capable of entering into a binding agreement to create an account.

4. Subscription and Billing

SiteWebster offers subscription plans billed in Canadian dollars. By subscribing, you agree to the following:

• Your subscription begins after the 7-day free trial period, unless cancelled before the trial ends
• Subscriptions are billed monthly in advance
• Pricing is displayed in Canadian dollars (CAD)
• Usage-based features (Voice AI, Conversation AI, SMS, phone numbers, and outbound calls) are billed separately through your account wallet
• You authorise us to charge your payment method on a recurring basis
• All fees are non-refundable unless otherwise required by law

5. Free Trial

SiteWebster offers a 7-day free trial with full platform access. No charge will be made during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged. You may cancel at any time before the trial ends through your account settings.

6. Cancellation Policy

You may cancel your subscription at any time through your account dashboard. Cancellations take effect at the end of the current billing period. You will retain access to the platform until the end of the period you have paid for. SiteWebster does not offer prorated refunds for partial months.

7. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Use the Service to send spam, unsolicited messages, or engage in any form of harassment
• Violate any applicable laws, regulations, or third-party rights
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Use the Service to transmit malware, viruses, or other harmful code
• Resell, sublicense, or redistribute the Service without written permission
• Use the Service in a way that could damage, disable, or impair the platform

Violation of this section may result in immediate suspension or termination of your account without refund.

8. Intellectual Property

All content, features, functionality, and technology on the SiteWebster platform are owned by SiteWebster Inc. or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your own business purposes. You retain ownership of any content you create using the platform.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy. You are responsible for ensuring that any data you upload or collect through the platform complies with applicable privacy laws.

10. Third-Party Services

The SiteWebster platform integrates with and relies on third-party services including GoHighLevel, Stripe, and others. SiteWebster is not responsible for the availability, accuracy, or reliability of these third-party services. Use of third-party services through our platform may be subject to the terms and privacy policies of those providers.

11. Limitation of Liability

To the fullest extent permitted by applicable law, SiteWebster shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the three months preceding the claim.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. SiteWebster does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We make no representations about the accuracy, reliability, or suitability of the Service for any particular purpose.

13. Termination

SiteWebster reserves the right to suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will remain in effect.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the date at the top of this page and notify you by email where appropriate. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
