Nobody gets excited about legal pages. We get it. So we kept this one as clear as we could. Here's how working with SiteWebster works, what you can expect from us, and what we expect from you.

These Terms & Conditions govern your use of SiteWebster’s website, services, software access, subscriptions, and related products.

By purchasing a service, signing an agreement, submitting payment, or using services provided by SiteWebster Inc. (“SiteWebster,” “we,” “us,” or “our”), you agree to these Terms & Conditions.

1. Our Services

SiteWebster provides website design, hosting, maintenance, CRM systems, automation, lead follow-up, review management, database reactivation, missed call text back, Call Connect, AI-powered tools, advertising services, integrations, consulting, and related digital services.

The exact services included in your purchase will be outlined on the applicable service page, proposal, invoice, order form, checkout page, or written agreement.

If there is a conflict between these Terms and a signed service agreement, the signed agreement will take priority for that specific engagement.

2. Project Scope

Your project includes only the services, pages, features, workflows, integrations, revisions, and deliverables specifically included in your selected package or written scope.

Requests outside the agreed scope may require an additional fee.

Examples of additional work may include:

  • Additional website pages

  • Custom graphics or illustrations

  • Video creation

  • Copywriting

  • Content migration

  • Landing pages

  • Newsletter design

  • Additional quiz funnels

  • Custom automations

  • Advanced integrations

  • Additional revisions

  • Additional training or consulting

We will let you know before completing work that will result in additional charges.

3. Client Responsibilities

You are responsible for providing accurate information about your business and supplying any content, approvals, access, credentials, branding, policies, or other materials reasonably required to complete the project.

SiteWebster may use onboarding calls, meetings, AI-assisted note-taking, email, or other communication methods to collect project information.

Delays in providing requested information or approvals may delay the project timeline.

You are responsible for reviewing your website, messaging, pricing, claims, policies, and other business information for accuracy before launch.

4. Payments

All fees are due according to the terms shown on your invoice, checkout page, proposal, or agreement.

Depending on the service, your purchase may include:

  • A one-time setup or implementation fee

  • A recurring monthly subscription

  • Usage-based charges

  • Advertising spend

  • Optional add-ons

  • Additional project work

Recurring subscriptions will continue to bill automatically until cancelled in accordance with the applicable agreement.

You authorize SiteWebster and its payment processor to charge the payment method on file for amounts properly due under your agreement.

5. Setup And Implementation Fees

Setup, onboarding, website build, migration, campaign creation, automation setup, custom configuration, and other implementation fees compensate SiteWebster for work performed to create and configure your service.

Unless otherwise stated in writing, setup and implementation fees are non-refundable once work has begun.

6. Recurring Services

Monthly fees may cover services such as software access, hosting, maintenance, CRM access, automation monitoring, support, reporting, AI functionality, or other ongoing services included in your plan.

The exact inclusions vary by plan.

Some third-party usage costs, including messaging, telephone calls, AI usage, advertising spend, premium integrations, or other metered services, may be subject to limits or additional charges.

Any applicable usage limits or overage rates will be disclosed with the service or agreement.

7. Minimum Terms And Cancellation

Certain services may require a minimum commitment.

Any minimum term will be disclosed before purchase through the applicable proposal, checkout page, order form, or agreement.

If no minimum term applies, recurring services may be cancelled according to the cancellation terms provided with your plan.

Cancellation stops future recurring billing but does not automatically refund fees already paid or amounts owed for work already completed.

Any outstanding invoices, usage charges, or contractual commitments remain payable after cancellation.

8. Website Ownership

Unless otherwise stated in writing, once all amounts relating to the website project have been paid, you own the custom website content and design work created specifically for your business.

You retain ownership of your:

  • Domain name

  • Business content

  • Logos and branding you supplied

  • Customer and lead data

  • Contact lists

  • Business information

  • Original media and intellectual property

SiteWebster retains ownership of its pre-existing systems, reusable workflows, templates, processes, code libraries, automation frameworks, internal tools, methodologies, and other intellectual property used across multiple clients.

Third-party software, fonts, plugins, platforms, stock assets, and licensed materials remain subject to their respective licence terms.

9. Framer And Third-Party Platforms

SiteWebster may build websites using Framer and may use third-party platforms such as CRM systems, payment processors, communications providers, advertising platforms, AI providers, analytics tools, and integration services.

Your use of these services may also be subject to the third party’s own terms, policies, availability, and pricing.

SiteWebster does not control third-party platforms and cannot guarantee that a third-party service will remain available, unchanged, error-free, or compatible indefinitely.

If a third party changes its pricing, policies, functionality, API, or availability, changes to your SiteWebster service or pricing may be required.

10. Hosting And Maintenance

Where hosting and maintenance are included, SiteWebster will take commercially reasonable steps to keep the website operational, secure, and maintained.

No website or online service can be guaranteed to operate without interruption.

SiteWebster is not responsible for outages, security incidents, service interruptions, domain issues, DNS issues, platform failures, or other problems caused by third-party providers or circumstances outside our reasonable control.

11. Revisions

Website and creative projects may include a defined number of revision rounds.

A revision round means a consolidated group of reasonable changes provided together.

New concepts, major structural changes, additional pages, new functionality, or changes that materially alter the original approved scope may be treated as additional work.

12. Search Engine Optimization

SiteWebster website projects may include basic technical and on-page SEO setup, such as page titles, meta descriptions, heading structure, image alt text, sitemap configuration, and search-friendly page structure.

Unless specifically purchased in writing, SiteWebster does not provide ongoing SEO campaigns, link building, ranking guarantees, or ongoing content-based SEO services.

We do not guarantee search engine rankings, traffic levels, or placement.

13. Advertising Services

For advertising services, results may depend on factors outside SiteWebster’s control, including market conditions, competition, seasonality, offer quality, budget, sales performance, platform algorithms, and customer behaviour.

Advertising spend is separate from SiteWebster’s management fees unless explicitly stated otherwise.

Where possible, advertising spend should be charged directly to the client’s own advertising account or payment method.

SiteWebster does not guarantee a particular number of leads, appointments, customers, sales, revenue, or return on advertising spend.

14. AI Services

Some SiteWebster services may use artificial intelligence for chat, telephone conversations, lead qualification, content assistance, follow-up, summaries, routing, or other automated tasks.

AI systems can occasionally produce inaccurate, incomplete, or unexpected responses.

Clients are responsible for reviewing and approving important business information provided to AI systems, including pricing, service areas, policies, emergency procedures, and other business rules.

AI services should not be relied upon for emergency, medical, legal, financial, or other high-risk decisions.

15. Messaging And Telephone Services

Some services use SMS, email, telephone calls, automated follow-up, or AI-powered communications.

You are responsible for ensuring that contacts supplied to SiteWebster were collected lawfully and that you have the necessary rights, consent, or lawful basis to communicate with them.

You agree not to use SiteWebster services for unlawful spam, deceptive messaging, harassment, or communications that violate applicable laws or platform policies.

SiteWebster may suspend campaigns or messaging activity that reasonably appears to create compliance, deliverability, or platform risk.

16. Database Reactivation

For database reactivation services, you confirm that you own or are authorized to use the contact list supplied to SiteWebster.

You are responsible for the accuracy, consent status, and lawful collection of those contacts.

SiteWebster does not guarantee response rates, appointments, sales, revenue, or specific campaign results.

17. Reviews And Reputation

SiteWebster may automate requests asking customers to provide reviews or feedback.

We do not guarantee that customers will leave a review or that reviews will be positive.

SiteWebster does not engage in review gating, suppression of legitimate negative feedback, or the creation of fake reviews.

18. Client Content And Legal Compliance

You are responsible for ensuring that materials you provide to SiteWebster do not violate copyright, trademark, privacy, advertising, consumer protection, or other applicable laws.

By providing content to us, you confirm that you have the right to use it and authorize SiteWebster to use it as necessary to provide the contracted services.

SiteWebster is not responsible for legal claims resulting from client-supplied materials, claims, promotions, pricing, offers, images, trademarks, or other content.

19. Portfolio Use

Unless you request otherwise in writing, SiteWebster may display completed work for promotional purposes, including on our website, portfolio, social media, proposals, and marketing materials.

We will not intentionally publish confidential business information as part of a portfolio example.

20. Confidentiality

Both parties agree to take reasonable steps to protect confidential information received during the engagement.

Confidential information does not include information that is publicly available, independently developed, or lawfully obtained from another source.

21. Results And Guarantees

SiteWebster does not guarantee specific business outcomes.

Websites, automation, advertising, AI, reviews, lead follow-up, and marketing systems are tools designed to support your business, but results depend on many factors outside our control.

Unless a specific written guarantee is provided, all services are provided without guarantees regarding leads, rankings, appointments, revenue, sales, conversion rates, or other performance metrics.

22. Suspension Of Services

SiteWebster may suspend or restrict services if:

  • An invoice becomes overdue

  • A payment method repeatedly fails

  • The service is being used unlawfully

  • The client violates platform policies

  • Continued operation creates security or compliance risk

  • The client materially breaches an agreement

Where reasonably possible, we will provide notice and an opportunity to resolve the issue.

23. Termination

Either party may terminate services according to the terms of the applicable agreement.

Upon termination, SiteWebster may disable access to software, automation, hosting, CRM systems, phone numbers, or other ongoing services controlled by SiteWebster after the applicable termination date.

Where technically possible and appropriate, we will reasonably assist with transferring client-owned assets.

Outstanding balances remain due.

24. Limitation Of Liability

To the maximum extent permitted by law, SiteWebster will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, lost data, or reputational harm.

SiteWebster’s total liability arising from a particular service will not exceed the amount paid to SiteWebster for that service during the six months immediately preceding the event giving rise to the claim, unless applicable law requires otherwise.

25. Indemnification

You agree to indemnify and hold SiteWebster harmless from claims, damages, liabilities, and reasonable expenses arising from:

  • Content or materials supplied by you

  • Your products or services

  • Your communications with customers

  • Your violation of applicable laws

  • Your misuse of SiteWebster services

  • Your violation of third-party rights

26. Force Majeure

SiteWebster will not be responsible for delays or failures caused by events outside our reasonable control, including internet outages, platform failures, natural disasters, government actions, labour disruptions, cyber incidents, telecommunications failures, or third-party service interruptions.

27. Changes To Services And Pricing

SiteWebster may update services, features, usage limits, or pricing from time to time.

Existing clients will be notified of material changes affecting their active subscription where required.

Pricing changes generally apply at renewal or after reasonable notice unless a third-party provider imposes an immediate cost or service change that requires earlier adjustment.

28. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

By using SiteWebster services, you acknowledge that information may be processed by third-party platforms necessary to provide the service.

29. Governing Law

These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.

Any dispute arising from these Terms or SiteWebster services will be subject to the courts located in Alberta, Canada, unless the parties agree otherwise in writing.

30. Entire Agreement

These Terms, together with any applicable proposal, invoice, order form, checkout page, service agreement, and Privacy Policy, form the agreement between you and SiteWebster regarding the applicable services.

If any provision is found unenforceable, the remaining provisions will continue in effect.
